AGC Texas Building Branch Legislative Update

What’s happening with AGC-TBB Legislative Priorities…
Contingent Payment

  • HB 734 by Rep. Warren Chisum has been referred to the House Business & Industry Committee
  • SB 324 by Sen. Bob Deuell has been referred to the Senate Business & Commerce Committee where it has been set for a Committee Hearing on Tuesday.

Consolidation of Public Construction Procurement Statutes

  • HB 447 by Rep. Bill Callegari has been referred to the House Government Reform Committee.
  • SB 356 by Senator Mike Jackson has not been referred to a Senate Committee as of today.

Construction Defects - Condominiums

  • Legislation to deal with this issue has been drafted and taken to Rep. Burt Solomon who has agreed to sponsor this bill in the House. The drafted bill has been sent to the Texas Legislative Council for final drafting before it can be introduced in the House.

Construction Defects - Public School Lawsuits

  • The language to take care of this issue has been drafted and shared with the Lt. Governor and his staff. AGC-TBB is awaiting the collection of additional factual information before this legislation can be shared with the appropriate Senate and House leaders.

Defense of Sovereign Immunity

  • To date, there has been no legislation filed that would diminish the legislative gains made by AGC-TBB in the past two legislative sessions. We will continue to monitor bills and amendments that might intrude on the sovereign immunity area.
     

What’s happening with
Immigration Bills…
Rep. David Swinford, Chairman of the House State Affairs Committee, will be asking Attorney General Greg Abbott to review the immigration bills that have been referred to his committee. A spokesperson for Rep. Swinford has stated that the committee does not want to pass anything out of committee that is unconstitutional. More than three dozen immigration-related bills have been filed during the session thus far.
